Terms & Conditions of Destín Clothing GbR

1. Scope and Contract Language
These Terms and Conditions apply to all orders placed through our online shop at https://destinclo.com.
The contract language is English.

2. Conclusion of Contract
The presentation of products in our online store does not constitute a legally binding offer.
By placing an order, the customer makes a binding purchase offer.
Acceptance of this offer occurs either through an explicit order confirmation by email or by dispatch of the goods.
The automated order confirmation does not yet constitute acceptance of the offer.

3. Prices and Payment
All prices are stated in euros (EUR) and include statutory VAT where applicable.
Shipping costs are shown separately during checkout.
We accept payments via Shopify Payments (Credit Card, Apple Pay, Google Pay), PayPal, Klarna (Sofort), and bank prepayment.
Payment is due immediately upon conclusion of the contract.

The customer’s right to offset is only valid if their counterclaims are legally established or undisputed.
A right of retention may only be exercised for claims arising from the same contractual relationship.

4. Delivery and Retention of Title
Delivery times and shipping costs are displayed during checkout.
We deliver within Germany and the EU.
The goods remain our property until full payment has been received.

5. Right of Withdrawal (Consumers only)
Consumers have a legal right of withdrawal of 14 days.
Details can be found on our Returns & Withdrawal Policy.

6. Warranty and Liability
Consumers are entitled to the statutory warranty rights.
For entrepreneurs (B2B), the warranty period is one year from delivery.
We are fully liable for intent, gross negligence, personal injury, and under the Product Liability Act.
For slight negligence of essential obligations, our liability is limited to foreseeable, typical damages.
Further liability for slight negligence is excluded.

7. Applicable Law and Jurisdiction
German law applies to all contractual relationships.
For business customers, the place of jurisdiction is our registered office in Freudenstadt, Germany.
Mandatory consumer protection laws of the customer’s home country remain unaffected.

8. Online Dispute Resolution
The European Commission provides an online dispute resolution platform (ODR):

We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.
